Justice Minister Regulates Off-Plan Sales Procedures with New Decision

Doha: HE Minister of Justice and Minister of State for Cabinet Affairs Ibrahim bin Ali Al Mohannadi has issued a decision to regulate the Preliminary Real Estate Register, detailing its data and procedures. This move is part of the executive measures under Law No. (6) of 2014, which governs the real estate sector and its subsequent amendments.

According to Qatar News Agency, the decision aims to align with the national vision, driving the real estate sector forward and enhancing its role in supporting national development. The components of the Preliminary Real Estate Register are specified to include real estate title records for off-plan units, supplementary registers, applications, contracts, legal instruments, architectural designs, and engineering plans that are duly approved by the competent authorities.

The decision mandates that the Preliminary Real Estate Register record detailed information for each off-plan unit, such as area details, original property number, approved project data, unit number, area, boundaries, specifications, common parts, and designated purpose. It will also register the owner's identity, share details in cases of co-ownership, acquisition cause, termination of ownership, daily register entries, ancillary real rights, related restrictions, and the grounds for their cancellation.

Assistant Undersecretary for Real Estate Registration and Authentication Affairs, Amer Saeed Al Ghafri, emphasized the significance of the ministerial decision. He stated that it aligns with the ministry's commitment to implementing executive decisions governing real estate registration and keeping pace with national development plans, particularly following the enactment of Law No. (6) of 2014.

Al Ghafri highlighted that the decision reflects modern practices in the real estate sector, especially concerning regulating off-plan sales, thereby enhancing confidence in the local market. Ownership interests will be registered in the Real Estate Register and granted legal protection. Notably, holders of preliminary title deeds will have the right to mortgage and transfer them, whether by sale or gift, in accordance with Qatar's existing laws.

To simplify procedures, the decision permits the electronic submission of applications for off-plan unit registration in the Preliminary Real Estate Register, following approval from the Real Estate Regulatory Authority "Aqarat" and in adherence to the procedures outlined under Law No. (5) of 2024.

Al Ghafri praised the collaboration between the Ministry of Justice and Aqarat in fostering a legislative environment that stimulates real estate sector growth and enhances its investment appeal. The Real Estate Registration Department is tasked with issuing Preliminary Title Deeds for each off-plan unit based on the recorded data, with annotations made on the original project land title record.
